Windshield

The windshield must meet Federal Motor Vehicle Safety Standard 205. Products or materials along the top edge of the windshield are permitted so long as they are transparent and do not encroach upon the AS-1 portion of the windshield.

Medical exemption

No person shall be convicted under the section if the person possesses a statement signed by a licensed practitioner of medicine and surgery, osteopathic medicine, or optometry verifying that tinted windows are medically necessary.

Enforcement

Vehicles with after-manufacture window tinting material must conspicuously display a certificate by the manufacturer of the tinting material. Exemptions apply to antique motor vehicles, street rods, and certain police vehicles including K-9 units and unmarked surveillance vehicles.

Notes

The statute (21 Del. C. section 4313) does not print numeric VLT percentages. Instead it requires that the front windshield, the side windows to the immediate right and left of the driver, and side wings forward of the driver meet Federal Motor Vehicle Safety Standard 205, whose light transmittance floor for glazing at levels requisite for driving visibility is 70 percent; the 70 in the numeric field is that incorporated federal standard, not a number printed in the Delaware statute, and a reviewer should confirm how it is enforced in practice. Windows behind the driver are not covered by the operative prohibition, so rear side windows and the rear window carry no state VLT floor in this section; no dual-mirror condition for dark rear windows was stated in the section text reviewed.
