The rules, window by window

Windshield

No object, material, or tinting may be displayed, affixed, or applied on the front windshield unless it has, in conjunction with the windshield, a light transmittance of at least 70 percent. Nonreflective sunscreening or window tinting material is allowed above the AS-1 line or within the top five inches (12.7 cm) of the windshield (NDCC 39-21-39(4)-(5)).

The standard in the law's own words

Subsection 1 separately prohibits any sign, poster, or other nontransparent material on the windshield, side wings, or side or rear windows that obstructs the driver's clear view of the highway.

Reflectivity

No general reflectivity limit is stated in NDCC 39-21-39; the only reflectivity language is that the windshield top-strip material must be nonreflective (subsection 5).

Medical exemption

No medical exemption provision appears in NDCC 39-21-39 as read from the official chapter text. Not confirmed either way whether an exemption exists elsewhere in the code or in administrative rules.

Enforcement

Equipment violation under NDCC ch. 39-21. The statute states VLT floors as combined (material in conjunction with the window) transmittance.

Notes

The 35 percent floor in NDCC 39-21-39(4) applies to any window other than the windshield, but the same subsection states it does not apply to windows behind the operator if the vehicle is equipped with outside mirrors on both sides meeting NDCC 39-21-38. With required dual outside mirrors, rear side windows and the rear window are therefore unrestricted; without them, the 35 percent combined-transmittance floor applies. The statute states the standard as the tinting in conjunction with the window (combined transmittance), not net film. No sedan vs MPV/SUV distinction appears in the section. A 2025 initiated-measure petition to repeal the tint law was circulating in North Dakota; the statute text read here is the current chapter text published by the legislature.
